These Terms & Conditions govern the relationship between you ("the Client") and Spot On Websites ("we", "us", "our"), an Australian business operating at spotonwebsites.com.au. By submitting your details and engaging our services, you agree to be bound by these terms.
Spot On Websites offers a custom-coded business website design service with unlimited pages within a normal service-business scope (as described below). The total website build fee is $699 AUD (inclusive of GST), collected in two milestones:
Payment of the $399 final milestone is also your signup payment for our Leads Unlimited ongoing plan, as set out in Clause 7. Paying that amount completes the website build fee and enrols you in Leads Unlimited from go-live (subject to technical setup), which includes hosting, ongoing SEO services (including managed local SEO content as we communicate at launch), and unlimited use of the Spot On Leads Portal Application for viewing and managing enquiries from your website. Recurring $99/month for Leads Unlimited does not start until two qualifying leads are collected within a 30-day period, as detailed in Clauses 7 and 8.
Process: (1) You complete our onboarding questionnaire. (2) You book and attend a handover call (typically via Google Meet) to align on scope and next steps. (3) We deliver work for your approval at each milestone. (4) After you pay both milestones, we proceed to go-live on our hosting under Leads Unlimited. The 30-Day Lead Guarantee is described in Clause 8.
No website build fees are charged for completing the onboarding form or booking the handover call. Milestone fees are only invoiced or collected after you approve the relevant stage, unless otherwise agreed in writing.
If you do not approve the initial design, you have no obligation to pay the $300 milestone and the project may be closed without further liability, subject to any work already agreed outside this standard offer.
This offer is available to Australian service businesses and is subject to availability. We reserve the right to limit intake (for example, to 10 new projects per week).

After we receive your completed onboarding, we will provide a link to schedule your handover call. The handover call is used to confirm scope, branding direction, and the process for design and copy approvals.
Initial design approval ($300): We will present an initial design (or design direction) for your approval. When you confirm in writing that you approve that stage, the $300 AUD (inclusive of GST) milestone is due.
Final revised copy approval ($399): We will present the site with revised copy and refinements for final approval. When you confirm in writing that you approve this stage, the $399 AUD (inclusive of GST) milestone is due. Together, the $300 and $399 payments constitute the full $699 build fee and, as described in Clause 1, your signup payment for Leads Unlimited is included in the $399 payment.
If you fail to schedule or attend the handover call within 30 days of our request, or unreasonably delay approvals without cause, we may archive or pause the project. Re-activation may require a new onboarding submission or a new quote.
Revisions are handled as part of reaching the two milestone approvals. Change requests should be reasonable and consistent with the agreed scope (layout, styling, copy, images). Requests that materially expand scope—such as building a large online store, major custom functionality, or an unusually large number of additional pages beyond a normal service-business site—may be quoted separately.
Revision requests should be consolidated where possible and communicated in writing (email or our agreed channel) within timeframes we specify at each stage. Additional work outside the agreed milestones may be invoiced at our standard rates.
Milestone payments are $300 AUD and $399 AUD respectively (each inclusive of GST, unless we state otherwise in writing). Payment is due upon your written approval of the corresponding milestone, by bank transfer, credit/debit card, or another method we agree.
Receipt of the full $699 build fee constitutes your acceptance of the completed website build as satisfactory for handover, subject to go-live on our hosting under Leads Unlimited as arranged.
Until the full build fee is received, we may withhold launch files or restrict transfer of final deliverables, except as required by law.
Upon receipt of full payment of the $699 build fee:
Prior to full payment of the build fee, all work produced remains the intellectual property of Spot On Websites.
You warrant that all content, images, logos, and other materials you provide to us are owned by you or that you have the legal right to use them. You indemnify us against any claims arising from third-party intellectual property infringement related to content you supply.
Stock images sourced by us on your behalf are licensed for use on your website under the applicable stock library licence. These images may not be used outside of your website without separate licencing.
Leads Unlimited is our primary ongoing plan for clients who complete the standard build. Your $399 final milestone payment (Clause 1) is the signup payment that enrols you in Leads Unlimited from go-live. Leads Unlimited includes, as one subscription:
When $99/month billing starts: You are enrolled in Leads Unlimited from go-live, but recurring charges of $99/month (inclusive of GST unless stated otherwise)—comprising a $29/month hosting component and a $70/month SEO and Leads Portal component—do not commence until two (2) qualifying leads (as defined in Clause 8) have been recorded within a single consecutive 30-day period. On the date we confirm that threshold is met (including by notice or your next invoice), $99/month billing for Leads Unlimited will commence and continue monthly until cancelled as below. Until that threshold is first met, no recurring Leads Unlimited subscription fees apply, subject to Clause 8 (including any period where fees are suspended during the guarantee remedy).
You may instead choose a lighter ongoing tier only where we offer it in writing at launch:

The 30-Day Lead Guarantee in Clause 8 applies when you are on Leads Unlimited, your site remains live on our hosting, you use (or cooperate with setup of) the Spot On Leads Portal Application and any agreed tracking so we can verify enquiries fairly, and you provide access to Google Search Console (or equivalent reporting we agree) where we need it to deliver SEO and confirm visibility.
Monthly services are charged in advance and billed on a calendar-month basis unless we agree otherwise in writing.
Cancellation: You may cancel Leads Unlimited (the $99/month bundle of hosting, SEO, and Spot On Leads Portal) at any time by providing 30 days' written notice to hello@spotonwebsites.com.au. If you cancel Leads Unlimited but your website remains on our hosting, hosting is still required at $29/month (Hosting—hosting only) unless and until you migrate the site off our servers under a written arrangement. You may not leave the site on our infrastructure with $0 ongoing hosting fees. No refunds are issued for the current billing period upon cancellation.
If you later cancel all hosting and move off our servers, we will provide you with a full export of your website files within 14 days, subject to any outstanding fees.
This clause applies only if you meet the eligibility requirements below.
Eligibility: (1) You have paid the full $699 build fee (both milestones). (2) Your website is live on our hosting and remains there. (3) You are enrolled in Leads Unlimited under Clause 7 (including from the $399 signup payment). (4) You cooperate within a reasonable time with setup of the Spot On Leads Portal Application, website forms, and any call-tracking or reporting we reasonably require so we can count qualifying leads fairly. (5) Where we request it, you provide access to a Google Search Console property for your live site (or follow our instructions to verify the property) so we can deliver SEO and, where relevant, corroborate organic visibility.
Qualifying lead: A qualifying lead means a genuine enquiry from a prospective customer about your services, received through contact channels on your live website (for example a contact or quote form submission, or a tracked phone enquiry we have configured and agreed with you). We may exclude obvious spam, wrong-number calls, sales solicitations to you, recruitment, and similar entries we reasonably classify as non-customer enquiries. We will use the Spot On Leads Portal Application, your nominated inbox, and/or agreed tracking as the primary record, and may reconcile in good faith if channels disagree.
Initial guarantee window: The first 30 consecutive calendar days beginning on the date we notify you in writing that the site is live, lead tracking is in place, and the guarantee period has started (the "Initial Guarantee Period").
Our undertaking: We undertake that you will receive at least two (2) qualifying leads during the Initial Guarantee Period.
When $99/month starts (all paths): Whether you meet the undertaking in the Initial Guarantee Period or only after a later 30-day window, recurring $99/month for Leads Unlimited (hosting, SEO, and Spot On Leads Portal—Clause 7) commences once two (2) qualifying leads have been recorded within a single consecutive 30-day period. From that point, standard monthly billing applies unless cancelled under Clause 7.
Remedy if the initial threshold is not met: If fewer than two (2) qualifying leads are recorded by the end of the Initial Guarantee Period, we will continue to perform SEO work for your site at no charge until you have received at least two (2) qualifying leads within a single consecutive 30-day period (measured from the start of that 30-day window). While this remedy applies, recurring subscription fees for Leads Unlimited are suspended; we will still provide hosting, the Spot On Leads Portal Application (on an unlimited-use basis as described in Clause 7), and the SEO work covered by the remedy without charging until that rolling 30-day threshold is met. Once that threshold is met, $99/month billing for Leads Unlimited will commence as set out above and in Clause 7, unless you cancel in accordance with Clause 7.
Exclusions: We are not obliged to provide the remedy where you withdraw access to the Leads Portal, lead forms, or Search Console; move the site off our hosting without our written agreement; apply noindex or robots rules that block indexing; fail to connect your domain or DNS as instructed; remove or break contact forms; or otherwise prevent lead capture or SEO delivery through no fault of ours; where Google imposes a manual action or penalty unrelated to our work; where you unreasonably delay launch or cooperation; where your trade or area has negligible legitimate search demand and we have disclosed that in writing before signup; or where circumstances outside our reasonable control prevent measurement. Apart from this clause, we do not guarantee specific search rank positions, click volumes, revenue, or any minimum leads beyond the undertaking above.
Nothing in this clause limits any rights you have under the Australian Consumer Law.
To allow us to deliver your website efficiently, you agree to:
Delays caused by the Client (e.g. late assets, missed calls, or extended approval delays) may extend delivery dates. We do not guarantee a fixed calendar delivery from onboarding alone; timing depends on mutual responsiveness and scope.
To the maximum extent permitted by Australian consumer law:
Nothing in these Terms limits or excludes any rights you may have under the Australian Consumer Law which cannot be legally limited or excluded.
Our services come with guarantees under the Australian Consumer Law that cannot be excluded. You are entitled to a replacement or refund for a major failure of service, and compensation for any other reasonably foreseeable loss or damage.
We warrant that our services will be rendered with due care and skill, and that the completed website will be fit for the purpose described — a professional online presence for your tradie business.
We treat all business information you provide to us as confidential and will not share it with third parties except as necessary to deliver your website or as described in our Privacy Policy.
Either party may withdraw from the project before you approve the initial design milestone and before any milestone invoice is paid, without obligation to pay build fees (unless you have already approved a milestone, in which case that milestone fee remains payable).
If you have paid only the $300 milestone but choose not to proceed to final approval, the project may be closed; whether any partial refund or credit applies will depend on work completed and will be assessed in good faith and in line with Australian Consumer Law.
After the full $699 build fee is paid and the site is delivered, these Terms continue to govern Leads Unlimited, any optional monthly services, and the 30-Day Lead Guarantee until cancelled or satisfied as set out in Clauses 7 and 8.
These Terms & Conditions are governed by the laws of Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Australia.
We may update these Terms from time to time. Updated terms will be posted on this page. For ongoing monthly services, we will provide 14 days' notice of any material changes. Continued use of our services after that notice period constitutes your acceptance of the updated terms.
